On-Road Rule – CARB staff has released its 15-day package

The final regulatory proposal for the Statewide Truck and Bus Regulation (the on-road truck rule) has been released. Interested parties now have 15 days to submit comments for the record and once that deadline passes staff will forward any additional changes to the Office of Administrative Law (OAL) for final legal review. Once accepted by OAL and signed off by the Sec. of State the rule becomes law with a first compliance date of January 2011.

CARB staff have announced a workshop on the GHG provisions of the regulation for September.

This is the portion of the rule which will require SmartWay efficiency devices like side fairings, hood scoops, low-rolling resistant tires, etc., but only for trucks that pull 53' or longer trailers.

Portable Engines - Tier 0 units will no longer be able to run in CA by January 2010.

As of January 1, 2010 the following changes will occur with the PERP (Portable Equipment Registration Program) rule:

NOTICE: CRITICAL REGISTRATION REQUIREMENTS

Engines that meet the non-road emission standard or tier level for newly built engines are eligible for registration in PERP. For 2009 and 2010, the current tier levels are:

• Engines rated 50 to 75 bhp: Interim Tier 4.
• Engines rated 75 to 750 bhp: Tier 3.
• Engines rated over 750 bhp and over: Tier 2.

Until December 31, 2009 for new engine applications: Engines which do not meet the current non-road tier standards must show that they operated in California between March 1, 2004 and October 1, 2006 and are subject to the registration fees listed on Form 1-B.

After December 31, 2009 for new engine applications: All engines must meet the current non-road tier standards listed above.

After December 31, 2009 for existing engine registrations for engines rated 50 bhp and greater: Registrations are cancelled for diesel engines which are not certified non-road Tier 1 or higher unless the engine is re-designated for emergency-use or low -use. Registrations are cancelled for non-certified spark-ignition engines unless the engine meets PERP Regulation Table 1 emission standards.
